NEWS: 1/31/2007: ... x-neighbor's attorney wrote a letter to Pepper, if she doesn't agree to their demands they will file suit for ADVERSE POSSESSION of a portion of her land so they can sell! Pepper is an 84 year old widdow! She's lived on the land since the '70's. These rich Californians (Marvin and Betty) bought 20+ acres next door to Pepper, built nice new buildings and a nice new fence (on Peppers property) about 10 years ago. I talked to Marvin about 5+ years ago. He said he wanted Peppers 2 acres but she wouldn't sell. Pepper loves animals far more than people. Marvin killed most all the wildlife and raised exoctic $40,000 goofy lamas or alpackas or something like that - for fun. Bettys son trained dogs with electric shock and killed one and went to jail for it, and Pepper said the son threatened to kill her at gun point. Pepper called the police - but was told: "We can't do anything unless he shoots you!", Pepper said. ... Marvin knew the old fence (some wire on rotten stakes) did not mark the property line - and I even mentioned it to him so I know he knew, it was off by 50 feet in places, but he went ahead and built a nice little building and fence on Peppers property - I think because he knew that in only 10 years (in Oregon) he could claim title to the land via the law of Adverse Possession. The fence and everything put Pepper on notice that he was claiming the land. But Pepper didn't know that he could actually claim and own it someday. That was 10 years ago. I asked Pepper why she never confronted him about it. She's been paying taxes on the land and she holds title to it. She said she was afraid of Marvin and Bettys son and didn't want to make things worse than they already were between them and didn't realize she had to do anything. I don't think Oregon has an elder abuse law like California or even if it could apply here. But I really don't like the law finding on the side of someone like Marvin who sets out to take anothers property. Most all the AP cases I can find - all parties beleived the fence/etc was the true property line, that's not the case here. And I don't think abandonment works under duress. Would the tax man lower your bill if you tell him the neighbor is using your land and you can't do anything about it?
Looking at the law - it sure looks to me like Pepper doesn't have a chance in court - assuming she could even muster the energy and resources to defend herself. I know she won't spend any money on an attorney. But wow, the HOSTILE possession was sure hostile - is that really how it's suposed to be? Like how hostile can a neighbor be to get your land? Everyone around here knew the fence was in the wrong place but no one did anything about it. Now I wish I did.
Oh, ... Marvin died a few years ago. His widdow, Betty, moved back to California very soon after and put the place up for sale. I don't know what happened to the exoctic anamils but it's been a lot quieter around here the last few years since Marvin is not out in his fields with his shot gun killing the little anamils. Betty was asking more than the property was worth I guess because it's not sold for a long time, and now she is going to sue Pepper for her land so it will sell easier. I'm sure Marvin was very wealthy and now Betty is even more wealthy - and living in sunny California. I just think this thing really sucks. That Betty can cause this much pain to an 84 year old woman just so he can sell her house here easier and for more money so she can live in expensive California in the sun having fun to me just seems wrong. I wonder how happy beautiful Betty will be when she's 84 - long after spending all the money she gained taking Peppers property.
